Buyers must sign a written agreement with their chosen broker before touring a home, whether in person or virtually. This agreement outlines the services to be provided, the compensation amount, and the terms negotiated with their agent.
If sellers have not offered compensation, buyers can include a request in their offer that the seller compensates the buyer broker. However, if the seller declines, the buyer will be responsible for paying their agent per the terms of the written agreement.
The listing broker or seller may still offer compensation to the buyer's agent, but these offers can no longer be communicated via a Multiple Listing Service (MLS).
If there is an offer of compensation to a buyer broker, the seller must approve the specific amount or rate in writing.
